Brit Pak Cargo and its employees or agents are not liable for any loss, damage, or delay under certain conditions outlined below. It is crucial for senders to familiarize themselves with these conditions and consider obtaining appropriate insurance coverage to safeguard their interests.
- Upon receipt, please inspect your parcel immediately. Responsibility for the parcel transfers to you once it is received.
- Parcels containing prohibited items are subject to disposal without prior notification.
- Refunds are contingent on the presentation of valid proof of purchase.
- If a parcel is not received in Pakistan and no enquiry has been made within 10 weeks of shipping, we reserve the right to dispose of the parcel without further notice.
- Expected delivery times range from 6 to 8 weeks. Please note that delays may occur due to unforeseen closures of customs offices.
- All deliveries are subject to customs clearance processes.
- The use of threats or abusive language towards our staff will lead to a refusal of refund, and your parcel may also be disposed of without notice.
- Our services do not include warranties covering damages from acts of war or natural disasters.
Our Obligations:
- Brit Pak Cargo commits to delivering the specified goods to the delivery address either by the agreed time or sooner.
- Brit Pak Cargo will not be held liable for any delivery delays caused by the unavailability of the consignee or other authorised recipients at the delivery address.
- Brit Pak Cargo is also not liable for any loss, damage, misdelivery, or delayed delivery of goods resulting from:
- Natural disasters such as storms, tempests, or floods (Acts of God).
- Acts of war, hostilities, civil unrest, or the threat or fear of such conditions.
- Criminal, malicious, or negligent acts or omissions by third parties.
- Industrial action or unexpected traffic disruptions, including vehicle breakdowns.
- Effects of ionising radiation or uncontrolled nuclear reactions.
- Suspension or cancellation of transport services due to adverse weather conditions or the threat thereof.
- Fire, lightning, or explosion.
- Seizure under legal process.
- Any act, default, or omission by the customer, their employees, agents, or any person with an interest in the goods.
- Inadequate or improper packaging, labelling, or addressing of the goods.
Please review these terms carefully to ensure full awareness and compliance.
Your Obligations:
Under the terms and conditions of this agreement, the customer is required to comply with the following stipulations:
- Ownership and Authority: The customer confirms that they hold either the sole beneficial ownership of the goods subject to this contract or have secured the necessary permissions from all relevant parties with an interest in the goods. This authorization empowers the customer to engage fully and comply with the terms outlined in this agreement.
- Indemnification: Should any third-party claims arise against the company stemming from this agreement, the customer agrees to indemnify the company. This indemnification covers all associated legal fees and additional expenses incurred. It is important to note, however, that this indemnity does not extend to instances where it can be demonstrated that the fault lies with the couriers, assuming the claim had been initially directed towards them and the customer had retained ownership of the goods throughout.
- Compliance with Instructions: The customer is required to promptly adhere to any directives issued by Brit Pak Cargo as specified in the relevant clause of this agreement. This is to ensure that all terms of the contract are met without delay.
- Timely Payments: The customer is obligated to ensure that all payments due under this agreement are made promptly according to the agreed schedule.
By accepting these terms, the customer acknowledges and agrees to their responsibilities while recognizing the protections this agreement provides to the company. This understanding is crucial for maintaining a smooth and effective contractual relationship.
Limitation of Liability:
- In instances of loss, damage, or incorrect delivery of goods, where liability is not otherwise excluded, CARGO's liability will be limited to the declared value of the goods as specified by the customer or as otherwise stated prior to shipment. This limitation will apply proportionally in cases where only part of the goods are affected. Additionally, CARGO will cover the cost of repairs or reconditioning of the damaged goods, up to a maximum of £150 per consignment or part thereof, in the event that only a segment of the consignment is compromised.
- Brit Pak Cargo shall not assume liability for any physical loss, incorrect delivery, or damage to goods that are prone to theft unless there is a prior written agreement from Brit Pak Cargo to transport such items, and provided the customer agrees in writing to bear any additional costs, including insurance, related to transporting these specified items. This exemption is valid only if the loss, incorrect delivery, or damage occurs during transit and can be directly linked to negligence by the courier, its employees, or its agents.
Excluded Goods:
- Customers are prohibited from sending certain types of goods for transport, and Brit Pak Cargo reserves the right to terminate the transport of such items at any point. The following items are explicitly banned from transport:
- Explosive materials, flammable items, firearms (including firearm components and ammunition), and detonators.
- Goods that are classified as hazardous.
- Any items that are illegal to possess or import into any of the countries along the planned transport route.
- Items that are explicitly prohibited as hand luggage by any carrier, including but not limited to British Airways or PIA.
- Materials that are obscene, blasphemous, scandalous, defamatory, or otherwise legally prohibited from transport.
Transit Conditions:
- Potential Interruptions: Transit operations may be temporarily suspended due to unforeseen circumstances.
- Loading and Unloading Procedures:
- When goods are collected or delivered, whether at the sender's or recipient's premises, Brit Pak Cargo is under no obligation to provide mechanical aids, electrical power, or manpower for the loading or unloading tasks.
Dangerous Goods Policy:
- Prohibited Items: Brit Pak Cargo explicitly refuses to carry or store goods that are deemed hazardous, infested, contaminated, or officially condemned.
Claim Submission Deadlines:
- Inspection of Damaged Goods: Goods suspected to be damaged must be made available for inspection by Brit Pak Cargo.
- Notification of Issues: Brit Pak Cargo disclaims liability for any loss, misdelivery, or damage unless the client submits a written notification outlining the concern within 20 days following the transit initiation.
- Formal Claims: All claims related to transit issues must be officially filed in writing within 42 days from the start of the transit period.
- Legal Action: The courier will be absolved of all liabilities regarding the consignment unless a legal claim is initiated within 10 weeks following the transit conclusion. In instances of loss, misdelivery, or non-delivery of an entire shipment, legal proceedings must be undertaken within 20 days after the issue is identified.
Governing Laws:
- This contract, along with its terms and conditions, is governed by and will be construed in accordance with the Laws of England.
